Terms of Service — YSS (Your Sailing Stats)

These Terms of Service ("Terms") are a binding agreement between you and [Legal Entity Name] ("YSS", "we", "us", "our") and govern your access to and use of the YSS sailing/GPS analytics service — the mobile app, website, and backend API (together, the "Service") available at https://your-sailing-stats.net.

Please also read our Privacy Policy, which explains how we handle personal data and is incorporated into these Terms by reference. Because the Service analyzes activity tracks, using it involves processing precise location data and, where your files contain it, heart-rate data; the Privacy Policy describes this processing and the choices you have.

1. Acceptance of these Terms

By creating an account, or by accessing or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to both you and that organization.

2. Eligibility

You must be at least [Minimum Age] years old (and old enough to form a binding contract in your country) to use the Service. The Service is not directed to children under that age. If we learn that we have collected personal data from a child in violation of this requirement, we will delete it (see the Privacy Policy, "Children's privacy").

The Service is currently offered free of charge, and we do not currently collect payment or billing information. We may introduce paid plans or premium features in the future; if we do, we will present the applicable prices and additional billing terms, and those terms will govern the paid features. Any references to "subscription tiers" in the Service today affect only usage/rate limits and do not represent a paid purchase.

The Service, including its software, design, text, graphics, and the YSS name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. We reserve all rights not expressly granted. This Section does not affect your ownership of Your Content (Section 5).

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as, in some jurisdictions, liability for death or personal injury caused by negligence, fraud, or certain consumer rights). Where such laws apply, your statutory rights are not affected.

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
